Learned counsel for the petitioner submits that the petitioner is in custody since 26th January, 2025. Charge sheet has been submitted. The CFSL report has not been submitted as yet. It cannot be said that the alleged substance recovered from the house of the petitioner is narcotic substance. The petitioner prays for bail.

Learned counsel for the state opposes the prayer for bail and submits that the recovered material has been sent for CFSL examination to Kolkata but the report is yet to be received. I have considered the material on record. Narcotic substance above commercial quantity has been allegedly recovered from the petitioner.

In view of statutory restriction laid down under section 37 of the NDPS Act, prayer for bail is rejected at this stage. Accordingly, CRM(NDPS)/6/2025 is disposed of.

Urgent photostat certified copy of the order, if applied for, be supplied to the parties, upon compliance of all necessary formalities.
