Ajit Ranjan Saojal Mr.Arul Prasanth ... for the petitioner Mr. N.A.Khan ... for the respondent July 31, 2024 [SR] Item No.4 The petitioner's eviction suit being Title Suit No.130 of 2011 was dismissed by the learned Civil Judge (Senior Division) at Port Blair by a judgment and decree dated November 20, 2016. The petitioner's First Appeal being Title Appeal No.04 of 2017 was allowed by the learned Court of Additional District, Andaman and Nicobar Islands, Port Blair by a judgment and order dated July 08, 2019. The opposite party's Second Appeal being SAT/11/2019 was dismissed by a learned Judge of this Court by a judgment dated November 16, 2021. Therefore, the eviction decree stands.

The petitioner says that the execution case is pending for the last two years. The petitioner is about 80 years of age. The execution case should be disposed of at an early date. The prayer is innocuous. Mr. Khan appears for the opposite party. He says that his client is willing to settle the matter with the petitioner. If that is so, nothing stands in the

way of the opposite party approaching the petitioner. This court cannot force a settlement.

The civil revisional application is disposed of by requesting the learned Executing Court to expedite the execution case being Other Execution Case No.03 of 2022 pending before the Civil Judge Senior Division to the fullest extent possible and conclude the same at an early date and preferably within six months from the date of communication of this order.

CO/24/2024 is accordingly disposed of.
