Mishra, Learned Advocate appearing for the respondents submits that this writ petition cannot be entertained inasmuch as, the petitioner's application for electricity connection stood rejected by an order dated December 20, 2024 and the same has not been challenged. A copy of such order is handed up to Court. The same is taken on record. It is further submitted that the petitioner has not arrayed the Assistant Engineer as a party respondent in the writ petition.
While this writ petition at one place in paragraph 5 of the writ petition, alleges that the petitioner's application has been rejected, at the same time in the same paragraph it has been asserted that the respondent electricity authorities have not considered the petitioner's representation even after lapse of one month. There is however no challenge to the order rejecting the petitioner's application. Since the petitioner's application has been rejected the allegation of inaction does not hold ground.
In such view of the matter, WPA/307/2026 is disposed of reserving liberty to the petitioner to challenge the order dated December 20, 2024 in accordance with law, if so advised. The petitioner shall also be at liberty to file a fresh application before the electricity authorities seeking electricity supply with all the relevant documents in case the petitioner so desires without challenging the order of rejection.
