The petitioner seeks implementation of the order being No.7998 dated 29th November, 2019 issued by the Secretary, Municipal Council.

Learned counsel for the private respondent submits that upon receipt of notice of the present writ application, an appeal has been preferred before the concerned authority assailing the order passed by the Secretary, Municipal Council along with an application under section 5 of the Limitation Act seeking condonation of delay in preferring the appeal. The order was passed on 15th November, 2019 whereas the appeal has been preferred on 29th July, 2025.

Be that as it may, since the order has been assailed by the private respondent in an appeal, the Appellate Authority is directed to consider and dispose of the appeal as expeditiously as possible, in the event the appeal is admitted, upon granting

reasonable opportunity of hearing to both the parties, in accordance with law, keeping in mind the time lapse between passing of the order and preferring the appeal. Since nothing further remains to be adjudicated in the present application, the writ petition is disposed of. There shall be, however, no order as to costs.

Urgent photostat certified copy of the order, if applied for, be supplied to the parties, upon compliance of all necessary formalities.
