Mr. C.S.Yasir ... for the petitioner Mr. Rakesh Kumar ... for the respondent September 26, 2022 [SR] Item No. 19 The petitioner claims to be the recorded tenant of a plot of land bearing survey No.100/2/2 having an area of 0.0950 hectares situated at Hasmatabad village under Ferrargunj Tehsil, South Andaman District.

The petitioner is seeking demarcation of his plot of land. The petitioner has made three applications. The first of which is dated 4th November, 2020 appearing at page 20. The next two applications were made respectively on 17th March, 2022 and 27th July, 2022 which are at pages 21 and 22 of the writ petition. The petitioner says that despite depositing the requisite fee for demarcation after having received a notice dated 23rd August, 2022, nothing has actually happened for the demarcation.

In the aforesaid facts and circumstances, I direct the sole respondent, being the Tehsildar, Ferrargunj Tehsil, South Andaman District to carry out the demarcation of petitioner's land as per applicable law by 30th November, 2022. The Tehsildar, Ferrargunj being the sole respondent in the writ petition shall be entitled to scrutinize the petitioner's documents, if necessary, and take assistance of appropriate personnel for the purpose of such actual demarcation. Since I have not called for any affidavits, the allegations contained in the writ petition are deemed to have not been admitted by the respondents.

The writ petition is accordingly disposed of. ( Arindam Mukherjee, J. )
