The Chairman, Port Blair Municipal Council and others Ms. A.S.Zinu Mr. N.K.Mishra ... for the petitioner Mrs. Anjili Nag ... for the respondents March 21, 2023 [AKB] Item No. 7 The writ petitioner claimed water connection at his dwelling house situated at a place mentioned in paragraph 3 to the writ petition. The petitioner contended that, the petitioner though had applied for the same before the respondent No.2, the connection had yet not been provided.

Ms. Anjili Nag, learned counsel appearing for the respondents submitted that, the application allegedly submitted was not in proper format and such information was also furnished to the petitioner by the relevant state authority. Considering the submission made on behalf of the parties and on perusal of materials on record, to sub serve justice, liberty is granted to the petitioner to apply seeking water connection at his dwelling house mentioned in paragraph 3 to the writ petition, within a period of two weeks from date in strict compliance with the formalities and requirements as required under the relevant law.

In the event, such an application is made by the petitioner, the respondent No.2 upon considering the same shall provide water supply connection to the petitioner strictly in accordance with law positively within a period of two weeks from the date of receipt of such application, if the petitioner is found to be eligible to receive the same in accordance with law. This order shall not create any right or equity in favour of the petitioner in any manner.

Since affidavits are not called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents.

On the above terms, this writ petition being WPA/513/2023 stands disposed of.
