The official respondent has been served.

The official respondent is represented.

In view of the nature of the order that I propose to pass, the presence of the private respondent may not be necessary. The grievance of the petitioner is that the private respondent is illegally occupying part of his property. He has made a representation to the concerned Tehsildar for taking appropriate steps in the matter. His grievance is that the representation has not yet been disposed of.

Having heard learned counsel for the appearing parties, I direct the Tehsildar, Port Blair, to dispose of the application/representation dated April 04, 2023, made by the present petitioner, by passing a reasoned order in accordance with law, within eight weeks from the date of communication of this order to the Tehsildar, after granting an opportunity of hearing to the petitioner and the private respondents or their authorised

representatives.

Appropriate consequential action be taken depending on the order that the Tehsildar passes. Since I have not called for affidavits, the allegations in the writ petition are deemed not to be admitted by the respondents. Let copies of this order be immediately forwarded by the petitioner to the Tehsildar, Port Blair and the private respondents. WPA/359/2024 is disposed of accordingly.
