The Hon'ble Lieutenant Governor and others Mr.Gopala Binnu Kumar ... for the petitioners Mr. Shatadru Chakraborty Mr. Debesh Dwivedi ... for the respondents March 22, 2023 [SR] Item No.10 In this matter, the conciliation proceeding was initiated which has come to an end with a failure, as appears from the paragraph-8 of the writ petition. The prayer of the petitioner for a direction upon the respondent no.3 to act in terms of the failure report dated 06.09.2022 submitted by the Conciliation Officer and to immediately refer the matters under section 10(1) of the Industrial Disputes Act, 1947 as mentioned.

I do not find any illegality and infirmity in the prayer made and therefore, I direct the respondent no.3 to take a decision in respect of the failure report of the Conciliation and to take steps in accordance with law i.e. Section 10(1) of the Industrial Disputes Act, 1947, as has been mentioned in paragraph no.8 and the decision is to be taken within a period of three weeks from the communication of this order, which is made mandatory.

With the above observation and direction, the writ petition, being WPA/535/2023, is disposed of. ( Abhijit Gangopadhyay, J. )
