Private respondent (in person) September 4, 2025 [AKB] Item No.4 The petitioners have filed the present writ petition assailing the order dated 25.07.2025 passed by the Central Administrative Tribunal, Kolkata Bench, Kolkata (Circuit sitting at Port Blair) in O.A. No. 351/490/2024. In the said O.A., the petitioners had challenged the provisional merit list of successful candidates prepared by the respondents for compassionate appointment to the post of Group 'C' under the Scheme of Compassionate Appointment, on the ground that the said list was published without due consideration of the objections filed by the petitioners.

After some arguments, learned counsel for the respondents submitted that the respondents are ready and willing to decide the objections filed by the petitioners against the provisional merit list, which was issued vide Press Note dated 08.03.2024.

Learned counsel for the petitioners, upon instructions from his clients, submitted that the petitioners would be

satisfied if their objections to the provisional merit list are duly considered by the department.

In view of the submissions made by the parties, this Court directs the respondents to consider the objections raised by the petitioners against the provisional merit list published vide Press Note dated 08.03.2024, and to pass a speaking order after affording an opportunity of personal hearing to all interested parties.

In light of the above arrangement and the statement made on behalf of the respondents, the challenge to the impugned order dated 25.07.2025 passed by the Central Administrative Tribunal, Kolkata Bench, Kolkata (Circuit sitting at Port Blair) in O.A. No. 351/490/2024 is rendered infructuous and is not examined on merits. All rights and contentions of the parties on the substantive issues are kept open. It is clarified that the respondents shall decide the objections filed by the petitioners independently, without being influenced by the observations made by the Central Administrative Tribunal in the aforesaid order/judgment dated 25.07.2025.

If the petitioners are aggrieved by the speaking order to be passed by the respondents, they shall be at liberty to challenge the same in accordance with law.

In view of the above the present writ petition is disposed of.
