[ CIRCUIT BENCH AT PORT BLAIR ] *** WPA/394/2024 S.Chander Dev Vs The Commissioner-cum-Secretary (Revenue) and another Mr.Prohit Mohan Lal ... for the petitioner Ms. Babita Das ... for the respondents August 8, 2024 [AKB] Item No.04 The grievance of the writ petitioner is that he has made a representation to the Deputy Commissioner, Port Blair South Andaman praying for sub division of the landed property.
It is in the representation dated 14.11.2023 that he is owner of the landed properties located at survey No. 144/1, 145/1 and 149/1 admeasuring 351 sq. mtrs, 1525 sq. mtrs and 240 sq. mtrs. respectively. He specifically prayed for sub division of the survey No. 145/1 admeasuring about 500 sq. mtrs already converted to house site. Since there was no response a further letter was sent to the Commissioner-cumSecretary (Revenue), Andaman & Nicobar Administration dated 19.01.2024. According to the writ petitioner both the letters are kept pending.
Mr. Lall, the learned counsel appearing for the petitioner submitted that the prayer is innocuous in the instant writ petition and the authority should take steps for sub division of the property in question without delay. Ms.
Das, learned counsel appearing for the Administration submitted that the Administration will look into the matter and would do the needful.
The writ petition is disposed of along with pending application, if any, with a direction to the respondent No. 2 to consider and dispose of the representation of the writ petitioner dated 14.11.2023 within thirty days from the date of communication of this order.
A copy of this order along with the original representation dated 14.11.2023 as well as 19.01.2024 shall
be served upon the respondent No. 2 the Deputy Commissioner, South Andaman forthwith.
Since no affidavits have been called for, the allegations contained in the writ petition are deemed not to be admitted by the respondents.
