IN THE HIGH COURT AT CALCUTTA

[ CIRCUIT BENCH AT PORT BLAIR ] *** CRR/44/2025 P.Prasanth Vs The State, CBI Mr. Md. Sharukh ... for the petitioner Mr.Rakesh Pal Gobind ... for the respondent August 04, 2025 [AKB] Item No.1 This is an application under Section 482 of the Code of Criminal Procedure.

It has been submitted on behalf of the petitioner that the petitioner was arrested and subsequently released on bail in connection with case being RC No. 121/2008. Later on a charge sheet was filed by the Central Bureau of Investigation and charges stood framed against the petitioner on February 10, 2021. It is further submitted that since then almost thirteen dates were fixed in the case but no witness has been examined by the prosecution till date. In such circumstances it is prayed on behalf of the petitioner that a direction be issued upon the learned Trial Court to dispose of the case in a time bound manner.

Learned advocate representing the Central Bureau of Investigation submits that the defacto complainant appeared before the learned Trial Court for his deposition, but the evidence could not be recorded on the said date due to the absence of the petitioner.

He further submits that the delay in the trial cannot be attributed to the Investigating Agency only, the petitioner has also contributed to such delay.

Having heard the submission made on behalf of the parties and upon consideration of the materials placed with the instant revisional application, it would be appropriate if the revisional application be disposed of with a request to the learned Trial Court to dispose of the pending case being Special Case No. 06 of 2018 as early as possible without granting any unnecessary adjournment to any of the parties, preferably within a year from the date of communication of this order. Accordingly, CRR/44/2025 is disposed of.
