Respondents Mr. Anil Kumar Chakraborthy Mr. Amit Malhotra ...for the Petitioner Mr. Rakesh Kumar ...for the Respondents September 27, 2022 [MAM] Item No.4 The petitioner seeks electricity connection at her premises bearing Survey No.4/P at Bamboo Basti (near Krishna Temple), Dairy Farm under Port Blair Tehsil. It is not disputed by the parties before this Court that though the petitioner is an encroacher in respect of the land in question, she has a settled possession over the said land.

The petitioner, therefore, cannot be deprived of electricity connection at her premises.

Accordingly, this writ petition is disposed of giving a direction upon the respondent no. 2 to effect the electricity connection at the premises of the petitioner within a period of two weeks from the date of communication of this order subject to compliance of all formalities by the petitioner. Needless to mention that grant of electricity connection shall not create any other right with regard to the land in question in favour of the petitioner.

WPA 476/2022 is accordingly disposed of.
