The Andaman and Nicobar Administration and others Mr. KMB Jayapal .... for the petitioner Mr. Shatadru Chakraborty Mr. Dibesh Dwivedi ... for the respondents April 18, 2023 [SR] Item No.16 The predecessor-in-interest of the petitioner encroached upon the government revenue land comprised in survey No.156/2 measuring an area of 1.33 hectares at village Swadesh Nagar under Mayabunder Tehsil which the petitioner is now occupying.

The representation of the petitioner for grant of licence in his favour in respect of the aforementioned government revenue land upon regularization is pending before the Deputy Commissioner, North and Middle Andaman, Mayabunder, respondent no.2 herein.

The grievance of the petitioner is delay in disposal of the said representation.

The said representation dated March 10, 2023 is appearing at page 35 being Annexure P-4 to the writ petition. WPA/571/2023 is disposed of by directing the respondent No. 2 to consider the said representation and disposed it of by a reasoned order, in accordance with law as

expeditiously as possible preferably within a period of six weeks from the date of communication of this order. Needless to mention that while disposing of the said representation, the said respondent shall give the petitioner and/or representative of the petitioner an opportunity of being heard and shall also permit to file relevant documents in support of his claim. There shall be no order as to costs. Since no affidavit has been called for, the allegations made in the writ petition are deemed to have been denied by the respondents.
