The State Mr. Anzer Ali ... for the petitioner Ms. A.S.Zinu ... for the State August 12, 2024 [SR] Item no.6 Learned advocate for the petitioner says that there was no recovery of contraband item from the petitioner. Recovery was made from Aanchal Halder and Santosh Kullu, who have both been enlarged on bail. Investigation is complete. Further custodial of the petitioner is not necessary.

We have seen the material in the case diary including the seizure list. There appears to have been no recovery from the petitioner. He is in custody for 286 days.

On an overall assessment of the materials on record, and that chargesheet has already been filed after completion of investigation and, the main accused persons have already been granted bail, we are inclined to allow this application.

Accordingly, CRM (DB)/12/2024 is allowed, hereby granting bail to the petitioner on condition that the petitioner shall furnish bond of Rs. 20,000 (Rupees twenty thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Port Blair. Further, the petitioner shall not make any inducement, threat or promise to any

person having acquaintance with the facts and circumstances of the case so as to dissuade such person from disclosing such facts to the court or to any police officer and or tamper with evidence in any manner whatsoever. Also, the petitioner shall not indulge in any criminal activity, including the offence which has been alleged against her in the present case.

Furthermore, the petitioner shall not leave the territorial jurisdiction of the trial court without leave of the trial court throughout the period of trial and shall attend each and every day of trial.

The case diary handed over to the court is returned to learned counsel for the prosecution.
