Mini ...for the Petitioner Mr. Ramendu Agarwal ...for the respondents November 24, 2022 [MAM] Item No.32 The Writ petitioner states that it made representation to the respondent no.4, the Tehsildar, Ferrargunj Tehsil, South Andaman, requesting him to demarcate its land bearing Survey No.285 measuring 0.6100 hectare and Survey No.286 measuring 1.4100 hectare. It is contended by the petitioner that despite representation made to the respondent no.4, no response has been received from him as to demarcating the aforesaid lands. Hence the petitioner seeks direction upon the respondent no.4 to dispose of the representation expeditiously.

Besides, the petitioner submits that the respondent no.4 be directed to evict the encroachers, if any, over the land.

Having heard learned Counsels appearing for the parties and on perusal of the materials on record I think that the writ petition may be disposed of by passing the following direction:

The respondent no.4 is directed to dispose of the representation dated 27.06.2022 of the petitioner within four weeks from the date of communication of the order after giving opportunity of hearing to the petitioner and all the interested persons. The respondent no.4 shall dispose of the representation by a reasoned order. However, there will be no direction as to the rest prayer of the petitioner. Thus, the writ petition stands disposed of. No order as to costs.

Since this Court has not invited any affidavit, the allegations in the writ petition shall be deemed to have been denied by the answering respondents.

Parties may act on server copy of this order. Photostat Certified Copy of this order, if applied for by the parties, may be supplied complying the requisite formalities.
