Mini, Member AWARD The dispute between the parties has been listed for determination by the Lok Adalat and the parties having compromised /settled the case/matter, the following award is passed in terms of the settlement. The petitioner used to enjoy electricity from Meter No. Z1/136. Allegedly, the meter was stolen from the premises and an NC FIR was lodged. The petitioner also made payment to the electricity department as per demand dated October 9, 2023 by the Assistant Engineer, Shaheed-Swaraj Sub Division, Haddo, Port Blair.

The writ petition has been filed for supply of electricity upon installation of new meter.

The Superintending Engineer, the Respondent No. 1 is personally present along with learned advocate. The petitioner is also accompanied by learned advocate.

It is submitted by the Superintending Engineer that if any one of the document prescribed under clause 5.30 of the Joint Electricity Regulatory Commission (for the State of Goa and Union Territories) Electricity Supply

Code) Regulation, 2018 is submitted by the petitioner, new electricity connection by a separate meter shall be granted upon installation of the meter in the same position as was earlier, and upon payment of usual charges and compliance of formalities.

Parties agree that supply of the meter shall not be construed as declaration of the court on the right, title and interest of the petitioner in respect of premises in question.

The petitioner will accordingly comply with necessary formalities and the electricity shall be supplied through a new meter within a month from compliance of formalities.

The petitioner will approach the electricity department on the basis of this order within a week from date.

The bench records settlement of the matter and disposal of the WPA/428/2024.
