In this matter the petitioner had made application for sub division of his land before the Deputy Commissioner, South Andaman, Port Blair on 01.04.2019. Pursuant to the application made by the petitioner for sub division of land the Assistant Commissioner by letter dated 19th July, 2021 requested the petitioner to submit a rectified proposal map rectifying some discrepancies which was pointed out in the said letter. The petitioner pursuant to the said letter submitted a letter/representation dated 24.08.2021 which is pending before the authorities.

Considering the facts of this case no fruitful purpose will be served in directing the respondent to file affidavit-inopposition. Thus this writ application is disposed by directing the respondent No. 2 to consider the application of the petitioner submitted on 01.04.2019 in accordance with law after giving the parties an opportunity of being heard. The petitioner is further directed to submit necessary clarifications and documents before the authorities which is already sought for in their letter dated 19th July, 2021. This consideration of the application made by the petitioner shall be done at an early date preferably within a period of six weeks from the dated of communication of this order. As affidavit-in-opposition is not filed the allegation are not deemed to be admitted.
