D.Vallaiah Vs The Deputy Commissioner and others Ms. A.S.Zinu ... for the petitioner Mr. V.D.Sivabalan ... for the respondent Nos. 1-2 August 11, 2025 [AKB] Item No.7 The instant writ petition has been filed by the petitioner seeking a direction upon the respondent authorities to dispose of the application filed by the writ petitioner on March 03, 2025. A further prayer has been made by the writ petitioner that the authorities may issue necessary direction restraining respondent No. 3, 4 and 5 from carrying out any type of construction till proper demarcation of the land in question. The application was filed before the authority with similar prayers. However, in course of hearing learned advocate for the petitioner submits that she does not want to press her prayer restraining the construction upon such respondents. She seeks a direction upon the authorities to consider and dispose of the application filed by the petitioner on March 03, 2025 upon hearing all the interested parties.

Learned advocate for the respondent Nos. 1-2 is present. Affidavit-of-service in respect of respondent Nos. 3, 4 and 5 is taken on record.

None appears on behalf of the respondent Nos. 3, 4 and 5 despite of service.

In the facts and circumstances of the case, let the writ petition be disposed of with a direction upon the respondent No. 1 and 2 to hear and dispose of the application filed by the writ petitioner on March 03, 2025 in accordance with law upon affording an opportunity of hearing to all interested parties. The respondent authorities shall be at liberty to hear such other parties and consult such other documents as the authorities may deemed fit and proper in the facts and circumstances of the case.

It is expected that the respondents authorities shall endeavor to disposed of the application dated March 03, 2025 within two months from date of communication of this order upon due service of notice upon all the interested parties. WPA/402/2025 is accordingly disposed of.
