Petitioner has applied for grant of electric connection on 23.03.2023 but when the petitioner intended to apply before the same authority, the authority refused to accept the same and as such the petitioner filed the instant Writ application. Mr. Tulsi Lall along with Mr. Rakesh Kumar representing the authority have denied the allegation made by the petitioner.

Considering the submissions made by the respective parties, this Court finds that the petitioner has not taken other recourse for submitting the document if the authority has refused to accept the same by hand and immediately the petitioner has filed the instant

application. No application is pending before the authority for consideration and as such the petitioner is given liberty to file afresh application before the authority for grant of electric connection.

The concerned authority i.e the respondent No.3, Assistant Engineer, Electricity Department, Hutbay, Little Andaman is directed that, if the petitioner will submit an application the same will be considered in terms of the order passed by the Special Bench within a period of four weeks from the date of receipt of the representation and to supply the electric connection to the premises of the petitioner after compliance of all formalities.

WPA No. 626 of 2023 is disposed of.
