[ CIRCUIT BENCH AT PORT BLAIR ] *** CRM/4/2025 The State Vs Shri J.Sasi Kumar Mr. Sumit Kumar Karmakar ... for the State Mr. Arul Prasanth ... for the respondent October 31, 2025 [AKB] Item No.14 The instant application has been filed for cancellation of the anticipatory bail granted by the Sessions Judge on 21st July, 2024 in Criminal Misc. Case No. 47/2025. On 04.08.2025 the regular bail was granted by Chief Judicial Magistrate in G.R.Case No. 295/2025. The learned advocate representing the State submitted there had been financial irregularity to the extent of Rs. 500 crores and the petitioner had been alleged to have been one of the person instrumental in such financial irregularity and accordingly the liberty granted to the petitioner in the form of anticipatory bail be cancelled.

The learned advocate representing the respondent - accused person submitted the charge sheet to have been filed on 18.09.2025 and on completion of investigation there was no probability to tamper the documents and therefore the prayer of the cancellation of the anticipatory bail be rejected. The learned advocate representing the State further submitted the possibility of filing a supplementary charge sheet.

Considering the facts and circumstances of the case since the original charge sheet has already been filed and the documents must have been in the custody of the investigating agency and the witnesses to have been already examined under Section 161 of the Code of Criminal Procedure the scope of the respondent - accused to interfere with the process of the investigation is remote.

The learned advocate representing the respondent accused further submitted that the condition imposed by the Sessions Judge while granting the prayer for anticipatory bail had been complied with by the respondent accused till date. Accordingly the instant application being CRM/4/2025 is dismissed.
