The petitioner claims to be an eligible pre-1978 encroacher. The petitioner submits that although her name appears in the list of pre-1978 eligible encroacher, till date no steps have been taken in terms of the said list by the Administration.

Affidavit of service is filed today.

Mr. Ajai Majhi, Learned Advocate stands in for Ms. Nag, Learned Counsel for the respondents.

The respondents are unable to assist this Court, although the matter appears by date today.

Considered the materials placed.

This Court is satisfied that the ends of justice shall be sub-served in the event the Deputy Commissioner, South Andaman District is directed to dispose of the representation of the petitioner.

Accordingly, the petitioner is directed to file a fresh comprehensive representation before the Deputy Commissioner,

South Andaman District, who shall dispose of the same in accordance with law, independently on merits within a period of eight weeks from the date of communication of this Order. The reasoned Order shall be communicated to the petitioner. Let the Deputy Commissioner, South Andaman District be added as a party respondent by the petitioner in course of today.

Leave is granted to the petitioner to amend the causetitle. WPA/559/2022 stand thus disposed of.
