1. The petitioner made a representation on 28.10.2023 to the Assistant Engineer, Chouldari Sub-Division, Electricity Department, South Andaman for new electric connection, is still pending for consideration.

2. Learned Advocate for petitioner submits that the application should have been disposed of within 30 days, as per regulation.

3. Learned Advocate for the respondent authorities submits that the petitioner prays for connection on the strength of a Circular of Ministry of Home Affairs, Government of India dated 9th May, 2003 but the authority unable to proceed, as he does not fulfill the necessary eligibility criteria, as set out under the circular.

4. Without entering into the merit of the entitlement of the petitioner to get electricity connection, the respondents are directed to consider the

representation of the petitioner in accordance with the law and if it is found that petitioner is eligible for electricity connection, he shall proceed to provide new electricity connection within 06 weeks from the date of communication of this order.

5. Respondents are also directed to communicate the fate of the representation to the petitioner at the earliest.

6. Learned Advocate for the respondents is directed to communicate this order immediately to the Respondent nos. 1 and 2.

7. Accordingly, Writ Petition 465 of 2024 is disposed of, but there is no order as to the cost.

8. Urgent Photostat certified copy of this order, if applied for, may be supplied to the parties upon compliance of usual formalities.
