Harish Kumar ... for the respondent November 7, 2025 [AKB] Item No.3 & 4 The learned advocate representing the State submitted the respondent to have demanded a sum of Rs. 5000/- as illegal gratification from the brother of the defacto complainant. Moreover, he was identified during the raid played by Trap Laying Officer whereby the chemical on the currency note changed its colour when the same was recovered from his pocket.

It was further submitted that learned Sessions Judge failed to assail the evidence of the prosecution witnesses in its proper perspective and declined to accept the corroborative statement of the prosecution witnesses in entirety. The learned advocate representing the respondent submitted the absence of any independent witnesses weakened the prosecution case.

Moreover, PW being defacto complainant was not involved in the process of seeking the mutation to be recorded in his name, however, it was with

regard to his brother. The articles were not deposited at the malkhana.

Considering the submission of the learned advocates representing both the parties and the severity of the offence agitated by the State satisfied this Court of prima facie issues to be dealt with. Let the instant appeal be admitted. CRMSPL/4/2025 is accordingly disposed of.

Registry is directed to call for Trial Court Records. Requisite numbers of paper books is to be prepared and served upon the learned advocates representing the appellant as well as respondent.

Let the matter be placed on 18.12.2025.
