The Secretary, Port Blair Municipal Council and another Mr. A.Venkatesh ... for the petitioner Mr. Tulsi Lall ... for the respondents April 25, 2023 (SR) Item No.8 The petitioner has encroached upon the land measuring about an area of 200 Sq.mts comprised in Survey No.77/P at Chidambaram Colony, Bathubasthi, Garacharma Ward under Port Blair Tehsil, South Andaman District. The petitioner with his family is residing at the aforesaid property. The petitioner applied to the concerned authority of the municipality for water tap connection in the said property. The said application is pending consideration before the authority.

It appears from the record that the Junior Engineer has forwarded the said application to the Assistant Engineer, Port Blair Municipal Council.

The Executive Engineer (Water Works), Port Blair Municipal Council, the respondent No. 2 herein is the authority to consider the said prayer of the petitioner for such water tap connection. The application since is pending from September 12, 2022, the respondent no. 2 is directed to dispose of it within a period of four weeks from the date of

communication of this order in accordance with law and shall communicate his decision to the petitioner. WPA/654/2023 is disposed of with the above terms without any order as to costs.

Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.

Urgent certified copy of this order, if applied for, be supplied to the learned advocates for the respective parties upon compliance of usual formalities.
