Disputes and differences have arisen between the petitioner and the APWD in respect of Construction of Rural Road at Gandhinagar i/c CC drain and retaining wall wherever required under CD Diglipur. The contract is dated 18.03.2013. 2.

There is an arbitration agreement at Clause 25 of the General Conditions of Contract.

This instant application has been filed under section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator.

In those circumstances, this Court appoints Justice Md. Nizamuddin, a former Judge of this High Court, Calcutta as an Arbitrator to enter into upon a reference and to pronounce award in terms of the Arbitration and Conciliation Act, 1996. 5.

The parties shall communicate this order to the appointed Arbitrator.

The application is disposed of . No order as to costs. 7.
