Disputes and differences have arisen between the petitioner and the APWD in respect of Construction at New Medical College at Port Blair; SW: Construction of 2 Nos. Hostel Block for Boys & 2 Nos. Hostel Block for Girls. SH: Construction of Hostel Block above plinth level (Super Structure). The contract is dated 16.09.2016 2.

There is an arbitration agreement at clause 52 of the said contract.

This instant application has been filed under section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator.

In those circumstances, this Court appoints Justice Debasish Kar Gupta, a former Chief Justice of this High Court, Calcutta as an Arbitrator to enter into upon a reference and to pronounce award in terms of the Arbitration and Conciliation Act, 1996.

The parties shall communicate this order to the appointed Arbitrator.

The application is disposed of . No order as to costs. 7.
