Pradeep ... for the appellant Mr. Salim Mohammed ... for the State April 24, 2023 [SR] Item No.3 This is an application for grant of bail under section 439 of the Code of Criminal Procedure, 1973 in connection with the Sessions Case No.18 of 2021 pending before the Sessions Court, at Port Blair arising out of FIR No.10 of 2021 dated 15th February, 2021 of PS Humfrygunj under section 302 of the Indian Penal Code.

It is found from the record that the investigation has been completed, charge sheet has been filed and the case is at the stage of trail. As per record, eleven witnesses have been examined and the learned Judge has already fixed the case for further evidence.

In view of the above, this Court is not inclined to grant bail to the petitioner at this stage. The learned Trial Judge is requested to expedite the trial.

CRM(DB)/12/2023 is dismissed.
