The Chief Engineer and another Mr. S.C.Goldar ... for the petitioner Mr. Rakesh Kumar ... for the respondents October 29, 2025 [SR] Item No. 7 The writ petition is disposed of with a direction upon the authority to consider the prayer of the petitioner for grant of water connection, if it is found that the petitioner is using and occupying the land in question. While doing so, the vendor shall also be heard along with the petitioner.

The agreement for sale dated March 25, 2025 indicates that the petitioner has got permission from the vendor to obtain electricity and water connection. It also appears that Rs.16.00 lakhs has already paid to the vendor while executing such agreement. The petitioner claims to be in possession of the land.

However, in the opinion of the Court, if the petitioner is in occupation of the land and is using the same and/or residing in the same, water being an essential commodity should be available at the plot.

The enter exercise shall be completed within a period of three months from the date. This order or grant of water connection shall not be construed as the opinion of the Court

on the right, title and interest of the petitioner in respect of the land in question.

It is needless to mention that, if the authorities are satisfied that the water connection should be given, the petitioner should comply with all formalities.
