Learned counsel for the petitioner submits that the respondent has filed the instant suit under Section 34 of the Arbitration and Conciliation Act challenging the award passed by the learned sole Arbitrator. Learned counsel for the petitioner submits that since the year 2019 the matter is pending for adjudication.

Considering the submission made by the counsel for the respective parties and perused the order sheets annexed with the application this Court find that none of parties will be prejudice if a direction is given to the learned District Judge at Port Blair for disposal of the Other suit No. 9 of 2019 (Executive Engineer vs. M/s Surendra Infrastructure Pvt. Ltd. within a period of six months from the dated of receipt of the copy of the order.

CO/26/2023 is disposed of.
