Ilango ...for the Appellant November 17, 2022 [MAM] Item Nos.4 & 5 This appeal has been preferred by the appellant/convict challenging the judgement and the order of conviction and sentence passed by the learned Special Judge (POCSO Act), Andaman & Nicobar Islands in Special Case No.01 of 2005.
The appeal has been filed within the statutory period. Admit the appeal.
Call for the LCR within one month from date.
After receipt of the LCR if it is found on examination that the LCR is in order, the Department shall prepare the requisite number of paper books and serve copies of the paper books upon the parties in accordance with the rules. Opportunity is given to the parties to mention the appeal for listing after the paper books are prepared and copies of the same are served upon the parties. By filing the application being CRAN 6 of 2022 the appellant seeks suspension of the sentence and permission to remain on the same bail.
I have heard learned Counsel on the application. On due consideration the application is allowed. Let the sentence imposed by the learned Trial Judge be suspended till the disposal of the appeal. The appellant is allowed to remain on the same bail as granted by the leaned Trial Judge.
In view of the above, the application stands disposed of accordingly.
