Mishra ... for the respondents November 03, 2025 [SR] Item No. 8 The writ petition is disposed of with the direction upon the concerned Executive Engineer, Public Health Engineering Division or any other competent authority, to treat the same as a representation of the petitioner and dispose of the prayer of the petitioner for grant of water connection at Survey No. 225/P, measuring an area of 200 Sq.mtrs, situated at New Bimblitan Village, Sri Vijaya Puram Tehsil.

Needless to mention, if the petitioner is found to be in settled possession of the property upon having constructed on the said plot, water connection should not be denied. Grant of the connection will not create any equity in favour of the petitioner and shall not be a proof of right, title or possessory interest of the petitioner in respect of the said plot. The said connection if granted, shall be subject to any other order that may be passed either by a competent or by a Court, in accordance with law.

However, if it is found that the petitioner is not in possession or no structure exists thereon, or if there are other disqualifications, in that event, a reasoned order shall be

passed and communicated to the petitioner. The petitioner shall also be heard by the concerned authority before any order is passed.

The entire exercise shall be decided within three months from the date of communication of this order. WPA/485/2025 is disposed of.
