The petitioner entered into an agreement on 11th August , 2015 for Provision of OTM Accommodation at Mayabunder with the Chief Engineer, Andaman and Nicobar Zone, Military Engineering Service.

Disputes and differences have arisen between the petitioner and the respondent in respect of the said contract dated 11.08.2015.

There is an arbitration agreement at Clause 70 of the General Conditions of Contract.

This instant application has been filed under section 11 of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator.

In those circumstances, this Court appoints Justice Debasish Kar Gupta, a former Chief Justice of this High Court, Calcutta as an Arbitrator to enter into upon a reference and to pronounce award in terms of the Arbitration and Conciliation Act, 1996.

The parties shall communicate this order to the appointed Arbitrator.

The application is disposed of . No order as to costs. 8.
