Mishra ... for the respondents November 10, 2025 [SR] Item No. 2 The writ petition is disposed of directing the concerned Assistant Engineer to consider the prayer for grant of electric connection in the premises allegedly occupied by the petitioner, bearing survey plot No.12/34, measuring an area around 200 sq.mtrs at 11/12 A C Lane Near Khaitan Hall, Prem Nagar Village, Sri Vijaya Puram Tehsil, South Andaman District. The authorities will make an inspection and if it is found that the petitioner is in possession, electric connection shall be given without the petitioner claiming any equity in respect thereof.

It is well settled that irrespective of the nature of possession, if a person is found to be in settled possession of any plot, electricity should be given to her, as an essential commodity. It is further made clear that the land should not be forest land.

However, this order or grant of such connection shall never be construed as an opinion of this Court on the right, title

and interest of the petitioner in respect of the premises in question.

The entire issue shall be decided within two months from the date of communication of this order.
