Yasir ...for the Petitioner Mr. Tulsi Lall Mr. Rakesh Kumar ...for the Respondents August 16, 2023 (M.A.Mobin) Item No.16 The application under Article 226 of the Constitution of India has been filed being aggrieved by the rejection on the part of the respondent authority to provide electricity connection.

The petitioner had filed an online representation dated 22.9.2022 addressed to the Assistant Engineer, Electricity Department praying for supply of electric connection in the dwelling house of the petitioner situated on the encroached Government Revenue land. The aforesaid application was rejected by the respondent authority with the remark "technical committee has stopped to provide electrical connection on encroached land" on 24.09.2022.

Heard the submissions of the learned Advocate for the petitioner as well as the respondents.

In view of the observation of the larger Bench of the Hon'ble High Court at Calcutta in Abhimanyu Mazumdar Versus Superintending Engineer reported in 2011(2) CHN (Cal) 768, the respondent authority is directed to provide electricity connection to the petitioner within a period of three weeks from the date of communication of this order upon due compliance of terms and conditions necessary for obtaining such electric connection being in possession of the premise for installation of electric meter without creating any proprietary interest upon the encroached property.

WPA No.716 of 2023 is disposed of.

The parties are to act upon the server copy of this order.
