The petitioner prays for a direction upon the Tehsildar, Port Blair Tehsil, to dispose of the application which was submitted through online mode on August 26, 2025, seeking mutation of his name to the extent of his 1/6 share over an area of 195.45 square meters, out of total area of 781.81 square meters, in Survey Nos. 76, 77, 95, 96 and survey No.97/1, all situated at Nayagaon Village.

The petitioner submits that such mutation has been prayed for on the basis of a WILL of Late Kishen Lall. The writ petition is accordingly disposed of with a direction upon the Tehsildar, Port Blair Tehsil to process the application in accordance with law and carry out the mutation if it is found that such mutation is permissible in law and as per the regulations.

If any dispute arises, the petitioner shall be called for a hearing and be permitted to submit all documents necessary in support of his claim

In the event it is found that there are other beneficiaries or other parties are involved, notices shall be issued to such interested parties and a hearing will be given to all. In the event, the Tehsildar finds that there are impediments in granting such mutation, the petition shall be disposed of by an order, which shall be communicated to the petitioner. The reasons for denial of the mutation shall be assigned in such a situation.

The entire exercise shall be completed within a period of three months from the date of communication of this order. Writ petition is disposed of.
