Union of India and Others Mr. Pijush Biswas Mr. Puspasish Gupta ... for the petitioner Mr. Shatadru Chakraborty ... for the respondents July 24, 2023 (SR) Item No.38 The present application has been preferred seeking extension of time for disposal of the arbitration proceeding, which is pending before the Arbitral Tribunal comprising of the Hon'ble Justice Jyotirmay Bhattacharya, [Former Chief Justice of High Court at Calcutta], Ms. Anjili Nag, learned advocate and Mr. Arjun Basu, learned advocate.

Mr. Biswas, learned advocate appearing for the petitioner submits that the arbitration proceeding has substantially progressed though it stood intervened by a period loss due to pandemic. There was some delay in preferring the present application since the petitioner was suffering from severe cardiac ailments. Such delay was not deliberate delay and as such the time towards conclusion of the arbitration proceeding may be extended.

Mr. Chakraborty, learned advocate appearing for the respondents submits, upon instruction, that the respondents do not oppose such prayer for extension of time.

Upon hearing the learned advocates and considering the materials on record, the time for disposal of the arbitration proceeding is extended for a further period of six months from date.

With the above observations and directions, the application, being AP/3/2023 is disposed of.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, may be supplied to the parties upon compliance of usual formalities.
