The grievance of the petitioner is that the police authorities have closed the complaint of the petitioner, which was lodged in the portal for Citizen Grievance Filing, maintained in the office of the Hon'ble Lieutenant Governor. According to the petitioner, a false complaint had been lodged by one Raja Pandian, who was a fictitious person. The petitioner wanted an investigation with regard to the identity of the person, who lodged such complaint. The police officer had denied to lodge an FIR in view of insufficient identity of Raja Pandian and also denied to track the IP address by citing that the grievance filed in the LG Help Desk could not be traced. Thus, the petitioner requested that the identification of the complainant may be disclosed or the Station House Officer, Cyber Crime be directed to trace out the person by tracking his/her IP address.
The said complaint was forwarded to the police authority, by the office of the Hon'ble Lieutenant Governor. However, the
police authority closed the case on the ground that the L.G.Help Desk Portal was hosted and managed by the National Informatic Centre, Sri Vijaya Puram and the Cyber Crime Police Station did not have any access to the portal. Identification of the source of the complaint required an approach to the hosting authority through official channels in order to obtain the IP address of the originator. Therefore, it was not possible for the police to identify the originator of the complaint.
It appears that the Shipping Services closed the complaint filed against the petitioner, on the ground that anonymous or pseudonymous complaints could not be acted upon.
Thus, as on today, there does not exist any complaint against the petitioner. The department in which the petitioner works, was of the opinion that the said complaint against her did not carry any weightage or element of truth in the absence of substantial verifiable evidence. The complaint was not found to be genuine.
Under such circumstances, at this stage, the petitioner does not need to worry about how the department is going to treat her. However, the petitioner has a right to seek an enquiry as to the originator of such false complaint. Hence, the petitioner also lodged a complaint in the said portal. The Cyber Crime Police Station was forwarded the complaint lodged by petitioner, by the office of the Hon'ble Lieutenant Governor. Thus, the Cyber Crime Police Station cannot abdicate its responsibility and duty to make the necessary enquiry.
The Cyber Crime Police Station shall approach the National Informatics Centre, Sri Vijaya Puram for necessary assistance, so that the IP address of the originator of the complaint against the petitioner dated July 11, 2025 can be traced and the identity of the originator of the complaint can be ascertained. The petitioner should be informed about the findings of the enquiry.
The National Informatics Centre shall render all necessary assistance and the police station shall reach the enquiry/investigation to its logical conclusion. The petitioner will submit a server copy of this order upon the Cyber Crime Police Station, Sri Vijaya Puram and also before the National Informatics Centre, Sri Vijaya Puram. This order is being passed because the office of the Hon'ble Lieutenant Governor was of the opinion that the petitioner's complaint called for an enquiry by the Cyber Crime Police Station.
Needles to mention that, the police authorities shall expedite the matter and inform the petitioner of the consequence of the investigation. The exercise shall be completed within three months from date of communication of this order.
The writ petition being WPA/513/2025 is disposed of accordingly. The closure of the case by the police authorities is not proper and hence the case is reopened.
