The Executive Engineer and Others Mr. Sudarshan Biswas .... for the petitioner Mr. Rakesh Kumar ... for the respondent no.1 December 15, 2025 [SR] Item No. 10 Affidavit of service filed in Court is taken on record. In spite of service , none appears for the respondents excepting the respondent no .1.

The petitioner claims to be the wife of R. Eswaran, since deceased, who was the government contractor by profession and engaged in various construction and repairing works. The husband of the petitioner died on April 02, 2011. The petitioner claims that several amounts are lying due and payable from the respondent authorities in the name of the deceased husband of the petitioner.

The petitioner obtained succession certificate and submitted a representation before the various authorities praying for release of the amount in favour of the petitioner. The learned advocate appearing for the petitioner submits that in spite of such representation, the respondent authorities have not yet taken any steps to release the sum. Mr. Rakesh Kumar, learned advocate appearing for the respondent no.1 submits that steps for releasing the amount in

favour of the petitioner shall be taken within the time limit as may be fixed by this Court.

In the light of the submissions made by the learned advocate appearing for the respective parties, WPA/518/2025 stands disposed of by directing the respondent authorities to consider the representation of the petitioner dated November 13, 2019 and to dispose of such representation, in accordance with law by passing a reasoned order after giving an opportunity of hearing to the petitioner or her authorized representative and to communicate the reasoned order to the petitioner as expeditiously as possible but positively within a period of six weeks from the date of communication of the server copy of this order along with the copy of the representation dated November 13, 2019.

Needless to mention that in the event the petitioner is entitled to any amount, the same shall be released immediately thereafter.
