And In the matter of Moline Vs The State Mr. Manas Ajai Sonkar ... for the petitioner Mr. Sumit Kumar Karmakar ... for the State November 18, 2025 [AKB] Item No.1 There is strong objection on behalf of the State as to the prayer of the petitioner for bail.

Mr. Sumit Kumar Karmakar, learned advocate appearing for the State has submitted that the petitioner has been the main conspirator of the entire crime, allegedly executed by the other co-accused persons. That she had all intention and motive to murder the victim.

On the other hand for the petitioner Mr. Manas Ajay Sonkar, learned advocate has submitted principally on two grounds. That the petitioner has been under custody for sixty seven days and she is at present seven months pregnant. Having heard both the learned counsels and perusing the case diary particularly the first charge sheet submitted on

28.09.2025, I find that investigation has already proceeded substantially.

Though police contemplate to submit a supplementary charge sheet in this case, the process of investigation shall not be jeopardized, if the petitioner be released on bail now. I consider that the petitioner is seven months pregnant and the investigation has been substantially proceeded with in the meantime. I also consider that she has already been imprisoned for sixty seven days. For the reasons as above, I find it proper to allow her bail as prayed for, primarily on the ground of her health. Accordingly, the petitioner may find bail of Rs. 10,000/- with two sureties of Rs. 5,000/- each, of which one surety must be local, with the satisfaction of learned Chief Judicial Magistrate at Mayabunder.

It is further directed that the petitioner should henceforth cooperate with the investigating authority in every manner, or else any deviation in the same may be brought to the knowledge of the Court for necessary direction.
