It appears that the private respondent has been served a notice of the order.

Counsel for the petitioner as well as the State submit that the construction has been stopped. The Tehsildar, Port Blair shall immediately take up the matter on the rival claims of the petitioner and the private respondent in respect of the land in question and dispose of the same, after given due hearing to the parties within a period of two months from date. The parties shall strictly abide by such order subject to any right in appeal.

Upon appropriate demarcation and findings, as regard the title to the disputed land in question between

the petitioner and the private respondent, consequential measures may be taken up by the parties.

The report be kept with the record.

WPA/702/2022 stands disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
