Vijay Kumar ... for the petitioner Mr. Shatadru Chakraborty Mr. Dibesh Dwivedi ... for the respondents July 28, 2023 (SR) Item No. 1 Mr. Kumar, learned advocate appearing for the petitioner submits that the land bearing survey No.957 measuring 200 sq.mtrs at Prothrapur was allotted to the petitioner's father. The same was demarcated by the surveyor and a report was sent to the Tehsildar. But subsequent thereto, no further steps were taken for inclusion of the petitioner's name in the rent roll. As such, the petitioner submitted a representation to the respondent no.2 on 9th August, 2017. In response thereto, the respondent no.2 initiated a revenue case being No.42223/PG/TSD/R/2018/8219 and issued a notice to the petitioner to participate in the proceeding on 28th December, 2018.
Pursuant to the said notice, the petitioner was present in the office of the respondent no.2 but no hearing was conducted. Thereafter, the petitioner has not been communicated any final decision in the Revenue Case being No.42223/PG/TSD/R/2018/8219 and aggrieved by such deceptive silence, the petitioner has approached this Court. Mr. Chakraborty, learned advocate enters appearance on behalf of the State.
Heard the learned advocates appearing for the respective parties and considered the materials on record. No instruction is forthcoming as to why the Revenue Case being No.42223/PG/TSD/R/2018/8219 has not yet been disposed of. In view thereof, this Court directs the respondent no.2 to take a final decision in the Revenue Case being No.42223/PG/TSD/R/2018/8219, upon granting an opportunity of hearing to the petitioner and other interested parties, if any, and to communicate the same to the petitioner.
The above exercise shall be completed within a period of six weeks from the date of communication of this order along with a copy of the writ petition.
The writ petition is, accordingly, disposed of There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, may be supplied to the parties upon compliance of usual formalities.
