It would have been prudent for the department to check before the writ petition was being filed on the basis of such Power of Attorney.
Learned advocate appearing for the respondent no.4 opposes the issue on the grounds of locus standi of the present petitioner by relying on the order of the Division Bench. Since I am not inclined to enter into the merits of the case as the writ petition was filed on the basis of the authority which itself is questionable, I am of the view that WPA/625/2024 be dismissed.
The interim order, if any, is hereby vacated. The same would not prevent the parties from taking any steps, if there is a right vested in law.
Pending application, if any, is consequently disposed of. ( Tirthankar Ghosh, J. )
