This instant writ petition has been filed by the petitioner seeking direction upon the Sri Vijaya Puram Municipal Council for implementation of the order of demolition dated 10.01.2022 passed by Sri Vijaya Puram Municipal Council in respect of the property situated under Survey No.14/1, measuring 14520 Sq. ft. situated at Junglighat Village, Sri Vijaya Puram Tehsil, South Andaman belongs to Asha Lata Biswas and four others. It is contended by the learned counsel appearing on behalf of the petitioner that the demolition order dated 10.01.
2022 was challenged before the Appellate Authority by way of first appeal and further it was challenged before the Second Appellate Authority (Administrator), Lieutenant Governor, Andaman and Nicobar Islands, Sri Vijaya Puram. The second appeal has also been finally disposed of 04.02.
order of demolition passed by the Municipal Authority has been confirmed by the second appellate authority.
In view of the above facts and circumstances, the respondent No.1 is directed to implement the direction for demolition dated 10.01.2022 if there is no impediment otherwise.
With the above observation WPA/629/2024 is disposed of without any order as to costs. Consequently, CAN/1/2026 is also disposed of.
It is made clear that the petitioner at liberty to challenge the final order passed by the Second Appellate Authority in accordance with law, if so advised.
