Shri Bhanu Pratap Singh Mr. Adarsh Ilango .... for the petitioner December 10, 2025 [SR] Item No.1 This application under Article 227 of the Constitution of India is at the instance of the respondent in the O.A No.7 of 2023 and is directed against an order dated November 21, 2025 passed by the learned District Judge at Port Blair. Learned advocate appearing of the petitioner submits that hearing of the appeal cannot proceed any further without a decision being taken on the application filed under Order XXXII Rule 15 of the Code of Civil Procedure. Learned advocate for the petitioner further submits that an application was filed by the petitioner on November 21, 2025 praying for adjudication of the application under Order XXXII Rule 15 of the Code of Civil Procedure prior to adducing evidence on the application under section 5 of the Limitation Act, but the same is yet to be disposed of.
After going through the order impugned, this Court finds that January 19, 2026 is fixed for cross-examination of the PW1 and for hearing of the petition under Order XXXII Rule 15 of
the Code of Civil Procedure as well as the petition dated November 21, 2025 filed by the petitioner herein. In view thereof, CO/73/2025 stands disposed of by requesting the learned District Judge, Andaman and Nicobar Islands at Port Blair to take up the hearing of the application under Order XXXII Rule 15 of the Code of Civil Procedure and the petition dated November 21, 2025 on the next date fixed i.e. on January 19, 2026 and to make an endeavour to dispose of the said applications as expeditiously as possible without granting any unnecessary adjournments to either of the parties. It will be open to the learned District Judge to decide which of the applications shall be taken up first.
With the above observations, CO/73/2025 stands disposed of.
