The writ application has been preferred praying for direction upon the Tehsildar, Sri Vijaya Puram Tehsil, South Andaman, the respondent No. 2 herein for execution of the Order dated 01.07.2025 vide No. G-68/TSVP/2025/1453. 2.

It is submitted by the learned Counsel for the private respondent that a suit for permanent injunction has been filed by the private respondent herein against the petitioner herein, before the learned Civil Judge (Senior Division), South Andaman District in Other Suit No. 82 of 2025 and the learned Trial Court vide an order dated 23.07.2025 in the said suit has been pleased to pass an ad-interim order of injunction and restrain the defendant therein, who is the petitioner herein, from interfering with the peaceful possession of the plaintiff/private respondent herein in respect of the suit property.

On perusal of the copies of the order sheets filed by the learned Counsel for the respondents, it appears that the civil suit is pending before a competent Court between the same parties. As such this writ Court is not inclined to pass any order as prayed for.

Accordingly, the petitioner herein is directed to appear before the learned Trial Court in the said suit which the learned Trial Court is directed to dispose of expeditiously. 5.

Considering the fact that a Civil Suit is pending adjudication in respect of the self same property, no order for execution of the order of the Tehsildar can be passed at this stage.

The relief of the petitioner herein now lies before the Civil Court.

The writ application is accordingly disposed of. 8.
