Shri.Mahender Kumar v. The Superintending Engineer And ANR
IN THE HIGH COURT AT CALCUTTA
[ CIRCUIT BENCH AT PORT BLAIR ] *** WPA/592/2025 Shri Mahender Kumar Vs.
The Superintending Engineer and Another Mr. S. C. Mishra ... for the respondents December 15, 2025 [AKB] Suppl. List Item No.1 Heard the learned counsel for the respondent - electricity department. None appears for the writ petitioner on repeated calls. As seen from the report filed by the respondent - electricity department, it appears that the Junior Engineer, Bambooflat, inspected the premises on 11.12.2025 and submitted the following observations:
"1. An existing electric connection bearing Consumer No. R/223 already exists in the plaintiff's house in the name of Shri Paul Raj (photograph of the electric meter installed on the wall is enclosed).
2. The plaintiff is already availing electricity supply; therefore, the question of deprivation of electricity does not arise.
3. There is no scope to provide a second electric meter for the same house situated on encroached land.
4. The plaintiff has purchased the house from Shri Paul Raj and intends to transfer the ownership of the said electric connection.
5. However, due to the shortfall of land ownership documents in his name, the request for transfer of ownership is not eligible for consideration.
6. The plaintiff is presently making payments for the said existing electric connection (ledger sheet enclosed).
Considering that the fact that the petitioner is already enjoying an electricity connection in the premises and has chosen not to appear before this Court today, the writ application is dismissed.
No order as to costs.
