Kanchanmala Chand Mr. Adarsh Ilango Mr. D..Bawali .... for the petitioner Mr. Siddhartha Singha ... for the opposite party December 09, 2025 [SR] Item No.5 This application under Article 227 is at the instance of the husband praying for a direction upon the learned Judge Family Court at Port Blair to dispose of the Matrimonial Suit No.243 of 2023 expeditiously.

The learned advocate appearing for the petitioner submits that the Matrimonial Suit has been filed sometime in the year 2023 and the same is still pending. He further submits that several interlocutory applications are also pending. Mr. Siddhartha Singha, learned advocate appears for the wife opposite party. He submits that a maintenance case has been filed which is still pending and the husband/petitioner herein has not yet paid a single penny on account of maintenance to the wife and the children.

From the order sheet appended to this application, it appears that an application under Order XI Rule 10 and 16 of

the Code of Civil Procedure is pending and December 15, 2025 is the date fixed for hearing of such application. In the light of the submissions made by the learned advocates appearing for the respective parties, CO/76/2025 stands disposed of by requesting the learned Judge, Family Court at Port Blair to take up the hearing of the application filed under Order XI, Rule 10 and 16 of the Code of Civil Procedure on the next date fixed i.e. on December 15, 2025, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the interlocutory applications, the learned Judge, Family Court shall make an endeavour to dispose of the Matrimonial Suit No.243 of 2023 as expeditiously as possible without granting any unnecessary adjournment to either parties provided the husband is not in default in payment of alimony and maintenance.

In the light of the above observations and directions, CO/76/2025 stands disposed of.
