Learned advocate representing the petitioner produces before this Court a licence to occupy land for house site in Form AG-I issued by the Assistant Commissioner on 05.10.1989 and claims that the same is the original of the licence, copy of which is annexed at page 66 of the writ petition.

The respondent authorities have refused to accept premium from the petitioner as the original file is not traceable. 3.
As the petitioner claims that he is in possession of the original licence issued by the authority way back in 1989, accordingly, the petitioner is directed to produce the said licence before the Deputy Commissioner, South Andaman within a fortnight from date.

The Deputy Commissioner, South Andaman shall ascertain veracity of the said document and take necessary consequential steps to accept premium from the petitioner if the said licence is found to be genuine.

If the licence produced by the petitioner is found to be genuine then, steps shall be taken by the authority to reconstruct the file so that the prayer of the petitioner can be proceeded with in accordance with law.

Steps shall be taken by the authority at the earliest but positively within a period of eight weeks from the date of production of the original licence before the Deputy Commissioner.

The impugned order of the Deputy Commissioner, South Andaman dated 5/6/7-12-2017 annexed at pages 64 and 65 of the writ petition shall not be given effect to. 8.
The writ petition stands disposed of. There shall be no order as to costs.

Urgent certified copy of this order, if applied for, be supplied to the parties upon compliance of usual formalities. ( Amrita Sinha, J. )
