1. From the affidavit of compliance it would transpire that the order dated 12th March 2025 though belatedly has been complied and a decision has been taken by the Andaman & Nicobar Islands Administration as would appear from order no. 2638 dated 24th October 2025 issued under the Signature of Deputy Secretary (UD) whereunder the resolution dated 27th November 2018 has been declared to be not conformity with law.

2. Records would reveal that this Court whilehearing out the writ petition noting the submission made by the parties and the amendment proposed to the recruitment rules, had directed the Administration to take a decision thereon. Though, the aforesaid order

appears to be cryptic, however, considering the fact that a decision has already been taken and though, the petitioner/complainant has filed an exception, I am of the view that shall not be appropriate at this stage to consider the validity and invalidity thereof in a contempt application, especially when there appears to be substantial compliance of the order.

3. It is true that the aforesaid decision has been taken belatedly, however, there appears to be some explanation for the same.

4. Having regard to the above, I am of the view that no fruitful purpose will be served in proceeding further with the contempt application.

5. The contempt proceeding is accordingly dropped and CPAN 63 of 2025 is disposed of leaving it open to the petitioner to agitate his grievance before the appropriate forum, if so advised.
