Union Of India Mr. Puspasish Gupta ... for the petitioner [through virtual mode] Mr. Tulsi Lall ... for the respondents July 26, 2023 (SR) Item No.22 The present application has been preferred seeking extension of time for disposal of the arbitration proceeding which is pending before the Hon'ble Justice (Retired) Ashoke Kumar Dasadhikari.

Mr. Biswas, learned advocate appearing for the petitioner submits that the arbitration proceeding has substantially progressed though it stood intervened by a period loss due to the pandemic. The mandate of the learned Tribunal is going to expire on 28th August, 2023 and it would not be possible to complete the arbitration proceeding within the said date and as such the present application has been filed. In support of such contention, he has drawn the attention of this Court to the minutes of the 21st sitting annexed to the application.

Mr. Lall, learned advocate appearing for the respondents, upon instruction, does not oppose the prayer for extension of time for disposal of the arbitration proceeding. Upon hearing the learned advocates appearing for the respective parties and as there had been no deliberate delay on

the part of the parties, the time towards conclusion of the arbitration proceeding is extended for a further period of six months from 28th August, 2023.

With the above observations and directions, the application, being AP/4/2023 is disposed of.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, may be supplied to the parties upon compliance of usual formalities.
